Why Is There a Rule Against Poetry Critics Quoting Poetry?
In a recent article, the poetry critic of the New York Times complained that to do poetry criticism right, it’s often necessary to quote extensively from a poem. Indeed, in the case of a short poem, it might be helpful to readers to copy the whole thing. But, the critic said, this can’t be done because it might run afoul of copyright law.
It is true that copyright law prohibits the unauthorized copying of any substantial part of someone’s poem, song, or other work. What does “substantial” mean? Well, in one recent case, a federal court held that rap group N.W.A.’s unauthorized sample of a two-second guitar chord was infringing. The court’s holding was clear: “Get a license, or do not sample.”
Is this a good policy? From an economic perspective, no. Use of a small bit of someone else’s creative work to build a new creative work rarely harms the economic interests of the first copyright owner, because most “derivative” works do not directly compete with the original. How I Know I Love My Wife
A year ago, my wife said to me, “I need you to do me a favor.” I knew that was bad news. A charity she is heavily involved with, Half the Sky, was planning an event in Chicago and she had volunteered me to be the speaker.
In principle, this was no big deal. I speak in front of groups all the time. I can talk about Freakonomics, SuperFreakonomics, and my academic research in my sleep.
I knew immediately, however, that this speech would be completely different. Although I often tell stories about myself and my life, they are never stories about emotions. I am one of the most closed off people you’ll ever find when it comes to emotional topics. I have never learned, or really even tried to learn how to express emotions. I’m not proud of this, it just is the truth.
There was no way, however, that I could speak at a Half the Sky event without opening up my emotions. Half the Sky is an amazing charity – perhaps one of the world’s best – doing incredible work with Chinese orphanages. The only events that ever fully penetrated my emotional wall were the death of my son Andrew and the subsequent, deeply moving process of adopting a daughter (eventually two daughters) from China. That’s the assertion of the new book Willpower: Rediscovering the Greatest Human Strength*, by Roy Baumeister, a research psychologist at Florida State, and John Tierney**, a New York Times science writer. The book builds off Baumeister’s research on the physical aspect of willpower, which he and his research collaborators found behaves like a muscle: it can be strengthened through exercise but it becomes fatigued from overuse. Willpower is generated in large part by sleep and diet, and feeds off of the glucose in our bloodstream.
Baumeister and Tierney argue that our ability (or inability) to exercise self-control is most often the key between success and failure.
